PART – I

Q No. 2. Write a note on Transfer of Decree and the issues to be resolved by the executing Court. (15 Marks)

Q No. 3. Under what circumstances a suit can be withdrawn? Discuss in detail its consequences including filing of fresh suit. (15 Marks)

Q No. 4. How can a suit against a minor, a pauper and person of unsound mind be filed? Describe also the procedure for filing of suit by them. (15 Marks)

PART – II
(The Limitation Act 1908)

Q No. 5. Under what circumstances delay in filing of suit or appeal can be condoned? (10 Marks)

Q No. 6. Comment upon factors considered while computing the period of limitation. (10 Marks)

PART – III
(The Registration Act 1908)

Q No. 7. Discuss the implications of non registration of a document which is otherwise liable to be registered. (10 Marks)

Q No. 8. Describe the nature of documents required to be compulsorily registered under The Registration Act, 1908. (10 Marks)

PART – IV
(The Qanoon e Shahadat Order 1984)

Q No. 9. Discuss in detail the doctrine of estoppel and compare estoppel with double jeopardy in Criminal Proceeding. (15 Marks)

Q No. 10. Define and describe burden of proof in civil and criminal proceedings. Illustrate when the onus shifts from one to the other party. (15 Marks)
